1. Acceptance of Terms

By accessing or using any website, application, or service provided by ByEmpire ("we", "us", or "our") — including byempire.org, DevHelper, PollsHub, and all future products — you agree to be bound by these Terms of Service ("Terms").

If you do not agree with any part of these Terms, you must not use our services. These Terms apply to all visitors, users, and others who access or use our services.

2. Description of Services

ByEmpire provides free, browser-based tools and applications designed for developers, professionals, and general users. Our current offerings include:

• DevHelper — A collection of 11 free online developer utilities (JSON Formatter, Regex Tester, API Builder, SQL Formatter, Code Diff Viewer, JWT Decoder & Encoder, Error Message Translator, .env Generator, Markdown Preview, Cron Builder, JSON Compare).
• PollsHub (coming soon) — An online platform for creating polls, quizzes, and surveys.

We reserve the right to modify, suspend, or discontinue any service at any time without prior notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

3. Acceptable Use

You agree to use our services only for lawful purposes and in a manner consistent with these Terms. You must not:

• Use our services to transmit, distribute, or store material that is unlawful, harmful, offensive, defamatory, or infringing on any third party's rights.
• Attempt to gain unauthorised access to our systems, servers, or databases.
• Conduct or facilitate any denial-of-service (DoS) or distributed denial-of-service (DDoS) attack against our services or any third party via our API proxy tool.
• Use the API Builder or any proxy feature to send requests to targets you do not own or have explicit permission to test.
• Use automated bots, scrapers, or crawlers against our services in a manner that places an unreasonable load on our infrastructure.
• Reverse engineer, decompile, or attempt to extract the source code of our services.
• Impersonate another person or entity, or misrepresent your affiliation with any person or entity.
• Use our services to violate any applicable local, national, or international law or regulation.

We reserve the right to terminate or restrict access for any user we reasonably believe is violating these Terms, without prior notice.

4. User Accounts

Some features of our services (such as saving tool history in DevHelper) require you to create an account. When you create an account:

• You must provide accurate, current, and complete information.
• You are responsible for maintaining the confidentiality of your password.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorised use of your account at enquire@byempire.org.

Account creation is entirely optional. All tools remain fully functional without an account. Tool history is only saved for authenticated users and is automatically deleted after 3 days.

5. Intellectual Property

The ByEmpire name, logo, website design, content, and all related materials are the exclusive property of ByEmpire and are protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any part of our services or content without our express written consent.

Your content: Any content you input into our tools (code, text, data) remains entirely yours. For guest users, your input is never transmitted to our servers. For authenticated users, any tool history you choose to save is processed solely to provide the history feature to you and is automatically purged after 3 days.

6. Your Data & Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data collection and use practices.

7. Advertising

Our services display advertisements served by Google AdSense. These advertisements help us maintain our services free of charge. By using our services, you acknowledge that advertisements may be displayed.

We do not control the content of third-party advertisements. We are not responsible for any products, services, or claims made in third-party advertisements or for any pages linked from such advertisements.

8. Disclaimer of Warranties

Our services are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation.

We do not warrant that our services will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected. Tool outputs (such as formatted code, regex results, or SQL explanations) are provided for convenience and should be independently verified before use in production environments.

9. Limitation of Liability

To the fullest extent permitted by applicable law, ByEmpire and its officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — arising from:

• Your access to or use of (or inability to access or use) our services.
• Any conduct or content of any third party on or through our services.
• Unauthorised access to or alteration of your data.
• Reliance on output generated by any of our tools.

In no event shall our total liability to you for all claims exceed the amount you have paid us (if any) in the twelve (12) months preceding the event giving rise to the claim, or £100 GBP, whichever is greater.

10. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including if you breach these Terms.

You may discontinue use of our services at any time. If you hold an account and wish to delete it, please contact us at enquire@byempire.org. Upon termination, your right to use the services will immediately cease.

11. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page. It is your responsibility to review these Terms periodically.

Continued use of our services after any changes constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
